Toxic Torts
Toxic Torts practice requires that we address issues on behalf of our clients that include:
- Providing advice to clients regarding the potential for exposure to chemicals personally, contamination of property or both
- Facilitating and coordinating the necessary medical testing to evaluate contamination
- Facilitating and coordinating the necessary sampling to evaluate contamination
- Defense or prosecution of civil actions related to alleged exposure to chemicals contamination of property or both
Toxic Tort matters in which the firm has or attorneys with the firm have been involved include the following:
- Plaintiff attorney in a civil action which results from one of the largest oil spills in Louisiana history from an oil refinery.
- Plaintiff attorney in a civil action which results from air releases from an oil refinery.
- Plaintiff attorney in more than fifty separate civil actions against production and exploration companies for historic oilfield contamination left behind on private properties leading to extensive groundwater and soil contamination.
- Plaintiff attorney in a civil action which results from air releases from an EDC cracking furnace tube rupture and a fire at a VCM manufacturing facility.
- Plaintiff attorney in a civil action which results from air releases from a valve failure and a large fire at a VCM manufacturing facility.
- Plaintiff attorney in a class action on the behalf of a class of plaintiffs where more than 3,000 properties had been trespassed upon and damaged by a 5 mile long plume of contaminated groundwater that contains tetrachloroethylene.
- Defense attorney in a civil action on the behalf of a real estate agent who participated in the sale of a property that allegedly contained contamination resulting from the activities of a prior owner.
- Plaintiff attorney in toxic tort and product liability case against manufacturers and contractors on the behalf of an alumina manufacturing company that suffered a massive steam pressure explosion which resulted in the release of chemicals that allegedly caused blast effect damage and offsite personal injuries.
- Defense attorney in several class action toxic tort suits on the behalf of an alumina manufacturing company that suffered a massive steam pressure explosion which resulted in the release of chemicals that allegedly caused blast effect damage and offsite personal injuries.
- Plaintiff attorney in a civil action which results from numerous releases of anhydrous ammonia over a period of several years.
- Defense attorney in a class action toxic tort suit on the behalf of a natural gas transmission company accused of sending contaminated gas to a chemical manufacturing facility which then allegedly resulted in the formation of a nitrogen mustard compound to which more than 300 plaintiffs were allegedly exposed as a result of the hydroblasting process equipment.
- Plaintiff attorney in the recovery of property damages for groundwater and surface water contamination of adjacent properties by a creosote operation.
- Defense attorney in a civil action on the behalf of a consulting company that performed a Phase I and Phase II assessment for the buyers of the property where the consultant discovered contamination that then resulted in a reduced sale price of property.
- Plaintiff attorney in a civil action which results from exposures to subsurface chemicals during well drilling and sampling.
- Defense attorney in two toxic tort suits, one a class action, on the behalf of an EDC/VCM/PVC manufacturer for the groundwater releases of chlorinated organic compounds that allegedly resulted in personal injuries to nearby residents.
- Defense attorney in a toxic tort suit on the behalf of a commercial TSD facility for alleged groundwater and air releases from hazardous waste disposal and treatment operations.
- Defense attorney in four toxic tort suits, one a class action, on the behalf of an EDC/VCM/PVC manufacturer for an episodic air release of VCM, EDC and HCl that allegedly resulted in personal injuries to nearby residents.
- Defense attorney in two toxic tort suits, one a class action, on the behalf of an EDC/VCM/PVC manufacturer for an episodic air release of VCM, EDC, HCl and ammonia that allegedly resulted in personal injuries to nearby residents.
- Defense attorney in a toxic tort suit on the behalf of a EDC/VCM/PVC manufacturer for an episodic air release of HCI and VCM that allegedly resulted in personal injuries to nearby residents.
- Defense attorney in two class action toxic tort suits on the behalf of a PVC manufacturer for a tank rupture and fire that involved an air release of HCI and VCM that allegedly resulted in personal injuries to nearby residents.
- Plaintiff attorney in a contractual indemnity claim on the behalf of a PVC manufacturer for a tank rupture and fire that involved damages to a client’s property and a release of HCI and VCM against the seller of the facility.
- Defense attorney in a toxic tort suit on the behalf of a Solid Waste Facility for alleged groundwater contamination that allegedly resulted in personal injuries and property damage to nearby residents.
- Defense attorney in a toxic tort and CERCLA suit on the behalf of a low density polyethylene manufacturer for a RCRA exempt product that was sold to a broker and misused by a purchaser allegedly resulting in damages to a ship’s engines. Investigated root causes, assimilated technical-legal facts. Case was settled.
