Remediation practice requires that we address issues on behalf of our clients that include:
- Providing advice to client regarding what remediation options are available for soil and/or groundwater contamination
- Coordination and facilitation of preparation of remediation alternatives studies and remediation plans
- Notifications and reporting related to groundwater impacts
- Defense of administrative or civil enforcement actions related to soil or groundwater remediation issued or instituted by state or federal administrative agencies
- Defense of civil actions filed by state and US departments of justice related to remediation issues after referral of administrative enforcement actions by state or federal environmental agencies
- Defense or prosecution of civil actions related to soil and groundwater contamination and the remediation thereof
Remediation matters in which the firm has or attorneys with the firm have been involved include the following:
- Plaintiff attorney in a class action on the behalf of a class of plaintiffs where more than 3,000 properties had been trespassed upon and damaged by a 5 mile long plume of contaminated groundwater containing tetrachloroethylene. - Defense attorney in a civil action on the behalf of a real estate agent who participated in the sale of property that supposedly contained contamination as a result of the activities of a prior owner. - Plaintiff attorney in the recovery of property damages for groundwater and surface water contamination of adjacent properties by a creosote operation. - Defense attorney in a civil action on the behalf of a consulting company that performed a Phase I and Phase II assessment for the buyers of the property where the consultant discovered contamination that then resulted in a reduced sale price of property. - Defense attorney in two toxic tort suits, one a class action, on the behalf of a chemical manufacturer for groundwater releases of chlorinated organic compounds that purportedly caused personal injuries to nearby residents. - Defense attorney in a toxic tort suit on the behalf of a commercial TSD facility for alleged groundwater and air releases from hazardous waste disposal and treatment operations.
