  • Environmental Law and Environmental Crimes Defense Experience
    • Defense attorney in a threatened environmental crimes action by the U.S. Department of Justice on behalf of a chemical blending company related to alleged discharges of chemicals to a city sewer system.  Currently investigating facts and working to EPA to develop additional facts to demonstrate that client was not the source of the discharges.  Will be presenting facts to the U.S. Department of Justice in an effort to avoid convening grand jury.
    • Defense attorney in a threatened environmental crimes action by the U.S. Department of Justice on behalf of an automobile salvage and recycling operation related to RCRA disposal issues, alleged groundwater issues and alleged RCRA regulatory violations. Negotiated with the Assistant U.S. Attorney, investigated alleged regulatory violations, assimilated technical-legal facts and developed defense strategies. The U.S. DOJ elected not to pursue criminal action one week prior to convening the grand jury.
    • Defense attorney in an environmental crimes action by the Colorado Attorney General on behalf of an automobile salvage and recycling operation related to RCRA disposal issues, alleged groundwater issues and alleged RCRA regulatory violations. Conducted pretrial motion hearings and discovery. Case settled.
    • Plaintiff attorney in a RCRA citizen suit action against an architectural hardware manufacturer that allowed or caused tetrachloroethylene to leak into the soil and groundwater resulting in a groundwater contamination plume over five miles long. Investigated alleged regulatory violations, assimilated technical-legal facts, located and coordinated experts and developed prosecutorial strategies. Propounded and responded to discovery and took depositions of defense experts.  Case is still in litigation.
    • Defense attorney in litigation with the U.S. Department of Justice and the EPA in U.S. District Court on behalf of a chemical manufacturer related to RCRA jurisdictional issues, groundwater issues, alleged RCRA regulatory violations, alleged CAA regulatory violations and alleged CERCLA release reporting violations. Investigated alleged regulatory violations, assimilated technical-legal facts, located and coordinated experts and developed defense strategies. Propounded and responded to discovery, defended the depositions of client's technical witnesses and took depositions of plaintiffs' experts. Case settled on second day of trial.
    • Plaintiff attorney in an EPCRA citizen suit action resulting from numerous releases of anhydrous ammonia over a several year period.  Investigated alleged regulatory violations, assimilated technical-legal facts, located and coordinated experts and developed prosecutorial strategies. Propounded and responded to discovery and took depositions of defense experts.  Case is still in litigation.
    • Defense attorney in a CERCLA private party cost recovery and toxic tort suit on behalf of a polyethylene manufacturer who was accused of negligence and intentional torts and was allegedly subject to punitive damages related to the storage and abandonment of mineral spirits at a small closed refinery which allegedly resulted in contaminated soil, a lost sale of the refinery and diminution in the value of the refinery. Investigated root causes, assimilated technical-legal facts, located and coordinated experts and developed defense strategies. Propounded and responded to discovery, defended the depositions of client's technical witnesses and took depositions of plaintiffs' experts. Case settled.
    • Plaintiff attorney in a CERCLA private party cost recovery action by the current owner of a chemical manufacturing plant against the prior owner for groundwater contamination due to product tank leaks. Left firm prior to case going to trial.

    • Defense attorney on behalf of a former owner and operator of a refinery in a state regulatory enforcement action under the hazardous waste regulations for remediation of groundwater
    • Defense attorney on behalf of a solid waste processing facility and had Solid Waste Order to Close reversed
    • Defense attorney on behalf of a chemical blending company in a state regulatory enforcement action under the hazardous waste regulations for allegedly failing to conduct hazardous waste determinations, allegedly failing to clean up spills of chlorinated solvents, allegedly storing a third party's hazardous waste, allegedly disposing of hazardous waste, allegedly failing to institute a personnel training program, allegedly failing to prepare a contingency plan and allegedly failing to notify the state of certain hazardous waste activities.
